Participation is voluntary and subject to TPBA's program rules and safety procedures.

2. Acknowledgment and Assumption of Risk

I understand that participation in basketball and athletic development involves physical exertion and inherent risks that cannot be eliminated even when reasonable care is exercised.

Potential risks include, but are not limited to:

  • Slips, trips, falls, and collisions

  • Sprains, strains, fractures, and dislocations

  • Serious injury, permanent disability, or death

I acknowledge these risks and voluntarily consent to participation.

I understand that injuries may result from the actions of the athlete, other participants, or dangers inherent in the activity.

3. Florida Statutory Notice to Parents and Natural Guardians

IMPORTANT FORMATTING REQUIREMENT: The following notice must appear in uppercase type at least five points larger than the rest of the waiver text and be clearly distinguishable from it. The exact registered name of the released TPBA entity must be inserted before this form is used.

NOTICE TO THE MINOR CHILD’S NATURAL GUARDIAN

READ THIS FORM COMPLETELY AND CAREFULLY. YOU ARE AGREEING TO LET YOUR MINOR CHILD ENGAGE IN A POTENTIALLY DANGEROUS ACTIVITY. YOU ARE AGREEING THAT, EVEN IF TOP PROSPECTS BASKETBALL ACADEMY USES REASONABLE CARE IN PROVIDING THIS ACTIVITY, THERE IS A CHANCE YOUR CHILD MAY BE SERIOUSLY INJURED OR KILLED BY PARTICIPATING IN THIS ACTIVITY BECAUSE THERE ARE CERTAIN DANGERS INHERENT IN THE ACTIVITY WHICH CANNOT BE AVOIDED OR ELIMINATED. BY SIGNING THIS FORM YOU ARE GIVING UP YOUR CHILD’S RIGHT AND YOUR RIGHT TO RECOVER FROM TOP PROSPECTS BASKETBALL ACADEMY IN A LAWSUIT FOR ANY PERSONAL INJURY, INCLUDING DEATH, TO YOUR CHILD OR ANY PROPERTY DAMAGE THAT RESULTS FROM THE RISKS THAT ARE A NATURAL PART OF THE ACTIVITY. YOU HAVE THE RIGHT TO REFUSE TO SIGN THIS FORM, AND TOP PROSPECTS BASKETBALL ACADEMY HAS THE RIGHT TO REFUSE TO LET YOUR CHILD PARTICIPATE IF YOU DO NOT SIGN THIS FORM.

4. Release of Liability for Inherent Risks

To the extent permitted by Florida law, I, in my individual capacity and, where applicable, as the minor athlete's natural guardian, release Top Prospects Basketball Academy, its identified legal operating entity, owners, employees, coaches, authorized agents, and affiliates from claims for personal injury, death, or property damage arising from the inherent risks of the covered athletic activities.

For minor athletes, this release is intended to operate only to the extent authorized by Florida Statutes § 744.301(3).

This agreement does not waive claims that Florida law does not permit to be waived, including claims arising from negligence of the commercial activity provider that is not an inherent risk of the activity.

5. Medical Fitness and Health Disclosure

I certify that the participating athlete is physically capable of participating in the selected activities, to the best of my knowledge.

I agree to disclose relevant medical restrictions or health conditions that may require reasonable modifications, precautions, or emergency planning.

Relevant information may include:

  • Allergies or severe allergic reactions

  • Asthma or other breathing conditions

  • Cardiac conditions or exercise restrictions

  • Prior concussions or injuries affecting participation

  • Prescribed emergency medication

  • Other conditions requiring special consideration

I understand that TPBA may recommend medical clearance or temporarily restrict participation when a reasonable health or safety concern exists.

6. Emergency Medical Authorization

In the event of an injury or medical emergency, I authorize TPBA personnel to:

  1. Contact emergency medical services when reasonably necessary.

  2. Provide basic first aid consistent with their training and available resources.

  3. Contact the designated parent, guardian, or emergency contact.

  4. Provide relevant medical and emergency contact information to responding medical professionals.

If a parent or legal guardian cannot be reached promptly, I authorize emergency evaluation and treatment for the minor athlete as permitted by applicable law.

I understand that TPBA does not guarantee access to on-site medical professionals.

I accept responsibility for medical charges associated with care provided to myself or my child, subject to applicable law and any legally responsible third parties.

7. Equipment and Facility Safety

I understand that TPBA may utilize basketball training equipment and performance development systems, including automated shooting machines, resistance training devices, weights, exercise stations, and other specialized equipment.

I agree that the athlete will:

  • Use equipment only when authorized.

  • Follow coaching instructions and facility safety procedures.

  • Refrain from horseplay, unsafe conduct, or misuse of equipment.

  • Immediately report injuries, malfunctioning equipment, or hazardous conditions.

  • Stop participating when experiencing pain, dizziness, or other concerning symptoms.

Use of specialized recovery services, including cold-water immersion, requires a separate screening and consent process when offered.

8. Athlete Conduct and Participation Standards

TPBA expects every athlete to maintain appropriate standards of behavior, including:

  • Respect for coaches, athletes, officials, and facility personnel

  • Compliance with safety instructions

  • Good sportsmanship

  • No bullying, harassment, threats, or fighting

  • Proper handling of basketball and training equipment

  • Appropriate conduct during practices, competitions, and academy activities

TPBA may suspend or terminate participation when an athlete's behavior presents a safety risk or violates academy policies.

Any refund or payment issue will be governed by the separate enrollment agreement and applicable law.

9. Parent/Guardian Responsibilities

For athletes under 18, the parent or guardian agrees to:

  • Provide accurate registration and emergency information.

  • Notify TPBA of relevant medical restrictions.

  • Arrange timely drop-off and pickup.

  • Inform TPBA of authorized individuals permitted to collect the athlete.

  • Comply with applicable facility, program, and spectator policies.

  • Communicate significant participation or safety concerns promptly.

TPBA is not a daycare, childcare, or general custodial supervision service. Supervision is provided during the defined activities and times specified by the applicable program.

10. Photography, Video, and Media Consent

This permission is optional and separate from the athletic liability release.

TPBA may photograph or record athletes for training analysis, educational content, academy communications, website materials, social media, and promotional purposes.

Please select one:

Choose from the following:
I CONSENT to TPBA using photographs, video recordings, and the athlete's likeness for the purposes listed above without additional compensation.
I DO NOT CONSENT to public or promotional use of the athlete's image or likeness.

Private instructional video recording, storage, and sharing will be addressed under TPBA's applicable privacy practices and program rules.

An athlete's refusal of promotional media consent will not, by itself, prevent participation in ordinary training activities.

11. Transportation and Off-Site Activities

I understand that TPBA programs may include competitions, tournaments, or other activities conducted away from the primary training facility.

This waiver does not, by itself, authorize TPBA to transport a minor athlete.

Any transportation involving TPBA vehicles, staff, or designated drivers requires separate written parent/guardian authorization detailing the applicable travel arrangements.

12. Scope and Duration

This waiver applies to the athlete's participation in TPBA activities identified in Section 1 during the following enrollment period.

Materially different activities, new equipment risks, or additional services may require separate disclosures and authorizations.

13. Severability and Governing Law

This agreement shall be interpreted under the laws of the State of Florida.

If any provision is determined to be unenforceable, the remaining provisions shall remain effective to the extent permitted by law.

Nothing in this agreement is intended to waive rights or legal protections that cannot lawfully be waived.

14. Acknowledgment and Signature

By signing below, I acknowledge that:

  • I have read and understand this agreement.

  • I understand the inherent risks associated with participation.

  • I have had the opportunity to ask questions.
